Embedded in Rule 1.1\, which requires attorneys to generally perform their duties with competence\, is a new “duty to keep abreast of the changes in the law and law practice\, including the benefits and risks associated with relevant technology.” Though “keep[ing] abreast” isn’t the clearest legal standard\, similar comments and rules have been adopted and enforced in 38 other states in the past few years. As such\, California legal ethics attorneys have a good indication of how this new comment will be enforced.
